James Comey has now been indicted three separate times by this administration.
Round one, September 25, 2025: two felony counts tied to his 2020 Senate testimony about the “Crossfire Hurricane” investigation. Trump celebrated on Truth Social, calling Comey “one of the worst human beings this Country has ever been exposed to.” Dismissed months later when a judge found the prosecutor who secured it, Lindsey Halligan, had been improperly appointed.
Round two, this April: a new indictment over a photo of seashells arranged to spell “86 47,” characterized as a coded death threat. Comey responded on video: “I’m still innocent. I’m still not afraid.” Days later, James Comey’s own daughter, Maurene Comey — a federal prosecutor who’d just secured a conviction against Sean “Diddy” Combs — was fired by email “pursuant to Article II” of the Constitution.
Round three, unfolding now: Comey’s lawyers filed a motion Monday to dismiss the seashell case, noting the numbers appear on thousands of commercial products. Separately, they allege the Secret Service “knowingly conducted illegal electronic surveillance” of Comey at a “high-level official’s” request — allegedly the same day Trump first called the photo a threat.
Three indictments. One dismissed on a technicality that shouldn’t have happened in the first place. One built on seashells now facing its own surveillance scandal.

According to people close to him, his legal team made that call after watching how House Republicans mined Jack Smith’s closed-door testimony for a false-statement referral — concluding there was nothing to gain engaging with a chairman who’s spent years promising to see him imprisoned. 🔴 OUTRAGE #3 — A JUDGE HAD TO ORDER ICE TO RELEASE THE ONLY WITNESS TO ITS OWN SHOOTING
On July 7, ICE agents chased down a work van in Houston and shot and killed the driver, Lorenzo Salgado Araujo — a 52-year-old father of three who’d lived in the U.S. for 35 years with no criminal record and was close to obtaining legal status. DHS claimed Salgado Araujo “weaponized his vehicle” against an officer. The surviving passengers say the opposite happened: that agents rammed the van before opening fire. There’s no body camera or dashcam footage from either side — the passengers are the only witnesses that exist.
So ICE detained all three of them. Not as suspects. As the only people who saw what actually happened. One of them, Jose Trinidad Rojas Pliego — a Mexican citizen with no criminal record, U.S. citizen children and stepchildren, and a pending U-visa application as a crime victim — sat in the Montgomery ICE Processing Center for three weeks until U.S. District Judge Keith Ellison, a Clinton appointee, ruled his detention was an “unconstitutional deprivation” of liberty and ordered him released within 48 hours. Ellison noted this is “one of hundreds of similar” habeas petitions he’s currently handling. Two other witnesses, including Salgado Araujo’s own brother, remain locked up.
Harris County’s District Attorney says federal officials still haven’t shared basic evidence with local prosecutors — not even the name of the officer who fired the shots. This is what happens when the agency being investigated also controls the witnesses.

Marc Rosenblum spent a decade running DHS’s Office of Homeland Security Statistics — the office responsible for publishing honest numbers on arrests, detentions, and deportations. This weekend, he resigned, writing on LinkedIn: “Between the war on immigrants, the war on feds, and the war on facts (not to mention the crazy war in Iran and the brazen corruption), I just need a change.”
Since Trump’s return to office, DHS has simply stopped publishing the ICE detention and deportation data Rosenblum’s office used to make public — the same office that shrank from 45 staff under Biden.
