The Curious Cyclist and the Crumbling Pool

On Friday, David Hearn — a 67-year-old retired canoe racer who represented the United States in three Olympic Games and won two World Championships — stopped his bike during a 52-mile ride through Washington, D.C., to take a look at the Reflecting Pool. He’d been reading about the renovation, the algae, the peeling paint. He was curious. He reached into the water and touched a piece of liner that was already detached from the pool’s wall — a chunk that was floating loose before his hand ever made contact with it — and briefly held it before a park worker told him to stop. He immediately let go. He took nothing. He walked toward his bike.

Then the handcuffs came out.

U.S. Park Police arrested Hearn on a misdemeanor charge of destruction of government property. He was held at the Park Police facility at Hains Point for five hours without a phone call before being released Friday night. “I didn’t vandalize anything,” Hearn said. “I didn’t destroy or break or peel anything. That’s the story as David Hearn tells it — and there is, conspicuously, no physical evidence that contradicts it. No video of him ripping anything. No chunk of liner removed from the pool. No damage that wasn’t already there when he arrived. What there is, instead, is a Truth Social post.

“These are very serious crimes having to do with the destruction of National Monuments. Years in jail,” Trump wrote. He added, without evidence, that the Reflecting Pool’s catastrophically peeling paint job was the result of intentional sabotage by left-wing vandals. The pool’s liner, which his administration installed at a cost of more than $14.65 million — $4 million over the estimated cost — began peeling almost immediately after being unveiled. Workers subsequently treated it with chemicals to fight the algae bloom, which caused further deterioration. The administration’s own renovation failed. There’s a word for what Trump demanded for a 67-year-old Olympic athlete whose “crime” consisted of touching a loose piece of already-failing liner during a bike ride. The word is disproportionate. The more accurate word is authoritarian. Decide which one fits you better, but sit with the fact that the same man who pardoned over 1,500 people who beat police officers with flagpoles and bear spray — wiping their records clean, calling them hostages and patriots — is calling for years of imprisonment for a curious retired canoeist touching a piece of peeling government property that was already peeling before he got there.

Washington’s grand juries, to their considerable credit, have seen this playbook before. Last summer, federal prosecutors attempted to charge Sean Dunn — “Sandwich Guy” — with felony assault for throwing a Subway sandwich at a federal officer during Trump’s police surge in D.C. A D.C. grand jury declined to indict him. Then a second case. Then a third. The pattern of pushback from grand juries against the DOJ’s surge-related prosecutions became so consistent that prosecutors were left bringing a misdemeanor charge instead. A D.C. jury then acquitted Dunn entirely after deliberating for several hours — finding that a footlong sub, thrown at a ballistic vest, did not constitute assault. Dunn, who had told officers at the scene “I did it to draw them away from where they were. I succeeded,” walked free. One hopes David Hearn’s case lands in front of a similarly clear-eyed grand jury on July 9th. The facts are, if anything, even weaker than Sandwich Guy’s. Dunn at least threw something. Hearn touched something that was already falling apart — something the government built, poorly, at enormous cost to taxpayers, and then blamed others for when it immediately began to fail.

There is a direct line between Trump’s Truth Social post calling for “years in jail” and the death threats Hearn is now receiving. That line runs through the same authoritarian logic that governs everything else this administration does: when something fails on our watch, find a scapegoat fast. Blame the left. Criminalize the curious. Demand years.

The Reflecting Pool is blue. Well, it was blue, briefly, before it turned green and started shedding its $14 million skin into the water. The next president will drain it, strip it back, and restore it. David Hearn, who spent his career navigating treacherous whitewater, should be nowhere near a courtroom when they do.
